By downloading or using Yawnly (the “App”) you agree to these terms and to Apple’s Licensed Application End User License Agreement (EULA), which applies to the App as the minimum terms. Where these terms give you more rights, these terms apply.

1. What Yawnly is (and is not)

Yawnly estimates when your baby’s next nap window is likely to open, based on your baby’s age and the sleep, feed and diaper events you log. It also lists possible reasons for crying computed from those logs.

Yawnly is not a medical device and does not provide medical advice, diagnosis or treatment. Its suggestions are general and may not fit your baby. Always use your own judgment, follow safe-sleep guidance from your health authority, and contact a doctor or emergency services if you are concerned about your baby’s health. Never rely on the App in an emergency.

2. Your account and data

Yawnly has no accounts. Your data stays on your device (see the Privacy Policy). You are responsible for keeping your device secure and for your own backups.

3. Subscriptions

• Yawnly’s features are available through an auto-renewable subscription (for example yearly or monthly) purchased through your Apple ID. Prices are shown in the App in your local currency before you subscribe.
• Where offered, a free trial converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. You can only use one free trial.
• Subscriptions renew automatically at the same price and period unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID at confirmation of purchase and at each renewal.
• You can manage or cancel your subscription any time in your device settings: Settings → [your name] → Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period. Deleting the App does not cancel the subscription.
• Refunds are handled by Apple under its policies (https://support.apple.com/HT204084). Your statutory rights as a consumer (for example in the UK, EU, Australia and Canada) are not affected by these terms.
• Prices and offers may change; changes apply from the next renewal and Apple will notify you where required.

4. Acceptable use

You may use the App for personal, non-commercial caregiving. You may not copy, modify, reverse-engineer, resell or misuse the App, or use it in a way that breaks the law or these terms.

5. Intellectual property

The App, its design, avatar artwork, text and code are owned by us or our licensors and protected by copyright and other laws. You receive a personal, non-transferable licence to use the App on Apple devices you own or control, as allowed by the App Store terms.

6. Disclaimer and limitation of liability

The App is provided “as is”. To the fullest extent permitted by law we exclude all warranties, and we are not liable for any indirect, incidental or consequential loss, or for any decision you make based on the App’s suggestions. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, or your rights under consumer protection law.

7. Changes and termination

We may update the App and these terms; continued use after an update means you accept the new terms. We may stop offering the App with reasonable notice. You may stop using the App at any time by deleting it.

8. Governing law

These terms are governed by the laws of the Republic of Bulgaria, without affecting mandatory consumer protection rules of the country where you live. Apple is a third-party beneficiary of these terms and may enforce them.
